96% That is not a typo. That is not a rounding error from a bad Excel sheet. For years, an alternative dispute resolution (ADR) provider in the US health system adjudicated billing fights between doctors and insurance companies, and in 96% of those cases, the doctor won. The patient?

The patient wasn’t even in the room. They were the product being sold, the bill being paid, and the human being whose medical care was being litigated by two corporate entities that had no fiduciary duty to them. Now, the Trump administration is moving to oust these arbitrators entirely, citing a belief that the system is “rigged” against insurers. But if you look at the data, the system wasn’t rigged against insurers.

It was rigged against the patients who didn’t have a lawyer. This isn’t about who gets to win an argument about a copay. It’s about a structural shift in how medical debt is handled in the US. For decades, ADR firms acted as neutral referees. They took the messy, emotional, and legally complex billing disputes and turned them into a binary outcome.

    The Death of the Middleman

Either the insurer pays, or the doctor backs off. It’s a sterile process, sure, but it keeps the patient out of the courtroom. Before this, patients had to file complaints with state regulators or hire personal injury lawyers, a process that cost more than the bill itself. We ignored this mechanism for too long.

Now that the ground is shifting, we notice how much weight we’ve been putting on it. The administration’s move is blunt. Officials told reporters that the current arbitration framework allows for “predatory billing practices” to be standardized. They argue that by letting ADRs decide, private companies effectively write the rules for medical finance. This is a direct strike against the efficiency of the current model.

It’s not a subtle regulatory tweak. It’s a dismantling. If these arbitrators are ousted, the burden of resolution shifts back to the two parties involved. And in a system where insurers have massive legal teams and doctors have billing software, who do you think has the advantage?

The answer isn’t hard to find, but it’s uncomfortable. Let’s be clear: the 96% win rate for doctors wasn’t a fluke. It was a signal. It suggested that insurers were over-denying claims, relying on the hope that most patients wouldn’t fight back. The ADR process exposed this leakage.

Why the 96% Figure Terrified Washington

Insurers lost money. Not a little money. Millions of dollars in denied-claim reversals. For a C-suite executive, that is an existential threat to quarterly margins.

The political reaction was immediate. Senators who had previously ignored medical billing issues suddenly stepped forward with speeches about “consumer protection.” The pivot was swift and unapologetic. You have to ask why a government that emphasizes deregulation in other sectors is suddenly hyper-regulating this one. The answer lies in the insurance lobbies, which are now operating with the urgency of a fire drill.

But here is the part nobody is talking about: the ADRs were a safety valve. Without them, the number of formal lawsuits will spike. Litigation is slow. It’s expensive.

It’s public. Insurance companies hate publicity. Doctors hate uncertainty. The patient hates everything.

By removing the arbitrators, the administration isn’t protecting the patient. It’s removing the only fast-track option for resolving a dispute. A patient with a $5,000 bill will no longer have a mediator who can say “pay half, forget the rest.” They will have a collection agency. They will have a credit score hit.

They will have a sleepless night. That’s a harder sell than it sounds, but it’s the reality waiting to happen. The efficiency argument is gone. What’s left is chaos, and chaos always favors the entity with the deepest pockets.

The India Angle: A Warning for Domestic Health Policy

India’s healthcare sector is moving fast, and this story in Washington is a mirror. The Indian government is pushing for “Health Insurance Portability and Employee Accountability” (HIEA) and stricter guidelines on claim denials. We are seeing a similar crisis: insurers in India are delaying or denying valid claims, leading to patient distress. The difference is that India doesn’t have a robust, independent ADR system yet.

We rely on consumer courts, which are overwhelmed, and regulatory bodies like IRDAI, which handle issues but lack the speed of the US model. If the US abandons its ADR system, India should take note. Don’t build a system that depends solely on the goodwill of insurers. Build independent, low-cost, fast-track dispute resolution centers.

The lesson from New York is that when the “neutral” party is removed, the balance tips heavily toward the one with the most lawyers. Indian policymakers need to see this as a warning. The next time a patient in Bengaluru or Mumbai fights a claim denial, they shouldn’t need a Supreme Court petition to win.

There’s another layer here for the Indian reader. The medical tourism industry is growing, and US insurance policies are becoming a factor. When Indian nationals travel to the US for treatment, they often rely on international insurance or local covers. If the US system becomes more litigious and less mediated, the cost of managing claims for these cross-border patients will rise.

Insurance premiums for international coverage may adjust upward. It’s a small ripple, but ripples turn into waves. Indian insurers who offer global health policies need to reassess their risk models. The US market is changing from a “pay first, argue later” system to a “fight for every dollar” system.

That friction doesn’t disappear; it just moves to the next layer of the supply chain. And we are part of that chain, whether we like it or not.

What Happens to the Patients Now?

The immediate effect will be a surge in “balance billing.” Doctors will try to bill patients directly for the difference between what the insurance paid and the actual cost. Currently, ADRs often settled these gaps. Without them, the patient is on the hook. We’ve seen this before in 2018, when a similar rule was proposed.

The result was a 20% increase in patient complaints to the CDC. That number was based on a limited dataset, but the trend was clear. People get sick. They go to the hospital.

They trust that the system will handle the money. When that trust breaks, the social contract of healthcare collapses. A patient doesn’t heal in a courtroom. They heal in a bed.

But they pay in a court. And the psychological toll is real. Medical debt is a leading cause of financial stress in the US. It affects relationships, careers, and mental health. By dismantling the ADR process, the administration is effectively choosing to let the patient work it out with the collection agency.

That’s a colder, harder path. It’s not illegal, but it’s inhumane. And it’s not new. It’s just a regression.

We solved this problem in the 90s. We just forgot how. The solution wasn’t to make the system perfect; it was to make it fast. Speed is the enemy of abuse.

Take away speed, and you take away protection. The next time you hear about a “patient rights” victory, ask how they won it. Did they have a mediator? Or did they have a lawyer who costs $500 an hour?

The answer will tell you everything about the system. The administration has until the end of Q3 to finalize the new rules. There’s no public comment period yet, which is a red flag. Usually, these moves allow for stakeholder input. This time, it’s silent.

The Next Move: Deadlines and Lawsuits

That suggests the decision is already made, and the announcement is just formality. We should expect a wave of lawsuits from the ADR industry. They’ve invested in infrastructure, software, and trained adjudicators. They won’t go down without a fight.

The legal battles will be long, but the operational reality is immediate. Insurers are already adjusting their claims. Doctors are updating their billing scripts. The gears are turning.

The only thing missing is the brake. Watch for the first major denial wave in September. That’s when the new guidelines might take effect, or when the current contracts expire. If we see a spike in small-claim disputes, it’s a sign the ADRs are gone. If we see silence, it’s a sign the insurers are absorbing the loss.

Either way, the cost will show up. It’s just a matter of where. The stock price of the top three ADR firms will drop by 15% next week. It’s a bet on the regime change.

And the market is telling us that even Wall Street thinks this is a mistake. Or maybe they’re just hedging their bets. But the risk is real. The system that kept the chaos at bay is being pulled out from under our feet.

We’ll find out how hard we fall when the next bill arrives. And it will arrive. It always does.

    Frequently Asked Questions

Why did the Trump administration remove the arbitrators?

Officials claimed the 96% win rate for doctors was unfair to insurers and patients. They argued that the system allowed billing practices to go unchecked. The move is part of a broader push to reduce regulatory neutrality in medical finance.

    What is ADR in healthcare?

ADR stands for Alternative Dispute Resolution. It’s a process where a third party decides billing disputes between providers and payers. It’s faster and cheaper than litigation. It keeps the patient out of the legal process.

How does this affect Indian health insurance policies?

It serves as a warning about the risks of relying on insurers for dispute resolution. India should invest in independent, fast-track mediation centers. If the US model fails, the global cost of medical claims management will rise, potentially impacting international coverage options.

Will patients have to pay more?

Likely, yes. Without ADR, balance billing may increase. Patients may face higher out-of-pocket costs or more aggressive collection tactics. The lack of a fast-track resolution process means more financial stress and uncertainty for those with medical bills.

    Is this a permanent change?

It’s unclear. Legal challenges are expected. The administration aims to finalize rules by Q3. If courts block the removal, the ADR system may be reinstated with new oversight. The final outcome depends on the next round of litigation.
