‘Nobody has the guts’: HD Kumaraswamy dares police to arrest him as Karnataka’s political crisis deepens

HD Kumaraswamy did not wait for a lawyer’s advice or a party instruction. He walked into the police station in Bengaluru, recorded a video on his phone, and dared the investigating officers to put handcuffs on him — right there, right then, for the alleged sting video scandal that has paralyzed the state government. The move is calculated, chaotic, and deeply personal. It signals that the former Chief Minister is no longer playing by the usual rules of Karnataka politics, where accusations are traded in parliament but rarely tested in the street.

By refusing to run, he has forced the police into a corner they may not want. The question now is not whether they will comply, but whether the machinery of the state can withstand the friction of arresting a man who still commands significant loyalty in the state assembly and among rural voters. The stunt has changed the temperature of the investigation overnight.

A direct challenge to the Commissioner

Kumaraswamy’s accusation is blunt. He claims that D.K. Shivakumar, the current Chief Minister, is engineering a conspiracy to distribute sleaze videos of Prajwal Revanna, a key figure in the JD(S) camp. He does not just suggest this; he points a finger directly at the police leadership, alleging that the Bengaluru Police Commissioner is acting strictly on Shivakumar’s instructions.

“They are using the police to crush politics,” he said in a statement released to journalists shortly after the video went viral. The charge is serious because it attacks the independence of the investigation itself. If the top cop is seen as a political agent, every subsequent arrest or charge-sheet becomes suspect. The police have not responded with a press conference, which is telling in itself. Usually, in high-profile cases, the IPS officer at the top would issue a clarifying note within hours to assert operational autonomy.

The silence suggests they are waiting for legal advice, or perhaps they are frustrated by a situation that is becoming more of a political spectacle than a criminal inquiry. Kumaraswamy knows this. By forcing the issue, he is making the police the center of the storm. If they arrest him, it looks like political vindictiveness.

If they don’t, it looks like complicity or cowardice. That’s a harder sell than it sounds. The public narrative is already shifting from “who made the video” to “who is protecting whom.”The politics of the ‘guts’ narrativeKumaraswamy’s use of the word “guts” is striking. It’s not legal language; it’s street language.

It frames the police not as neutral enforcers of law but as thugs who need the courage to do their job. This framing is designed to win the sympathy of the middle class and the urban youth who are often skeptical of institutional honesty. He is positioning himself as the only man willing to stand in the open, while his opponents are seen as hiding behind bureacratc curtains. The video has been shared over 500,000 times in the first 24 hours, according to social media analytics firms.

Most of the comments are not about the legal merits of the case. They are about the principle of accountability. But there is a risk in this bravado. Legal experts warn that voluntary presentation to police does not guarantee immunity from future charges, nor does it stop a trial if the case proceeds. It is a symbolic act, not a legal shield.

Nevertheless, in the court of public opinion, symbolism often outweighs statute. Kumaraswamy has turned a potential criminal defense into a political platform. He is forcing his opponents to choose: do they let him go, appearing weak, or do they arrest him, appearing brutal? There is no middle ground.

And in Karnataka, where votes are counted to the single digit, there is no safe middle ground. The political cost of inaction is now higher than the risk of legal complications. What This Means for IndiaFor Indian readers across the country, this is more than a local squabble. It is a warning about the fragility of institutional trust in Indian state politics. When the police are accused of being extension arms of the Chief Minister’s office, it damages the credibility of the entire law enforcement ecosystem in Karnataka.

This matters for investors. Karnataka is India’s second-largest economy by GDP, home to 40% of the country’s software exports. Uncertainty at the top of the state administration spooks global tech firms. They don’t like sudden legal turbulence involving high-profile leaders, especially if it suggests a party-state apparatus rather than an independent judiciary. The ripple effect could also touch the central government.

The BJP, which is currently in opposition in Karnataka but holds power in New Delhi, could use this to demand an SIT (Special Investigation Team) from the Centre, arguing that state police are compromised. If the Centre intervenes, it sets a precedent that could embolden opposition parties in other states like West Bengal, Telangana, and Tripura to demand similar federal interference. That would be a major constitutional shift. For now, the focus is on the chaos in Bengaluru, but the shaked foundations of state-level policing are being felt in boardrooms in Gurugram and Noida.

Nobody wants to be the next target of a politically motivated investigation. The legal minefield of sting operationsThe underlying issue is the legality of the original sting. In India, recording conversations without consent is a complex legal area governed by the Information Technology Act and criminal procedure codes. Courts have often ruled that illegally obtained evidence can be inadmissible. If Kumaraswamy’s team can prove the video was planted or edited, the case collapses.

But if the video is authentic, the distribution charge is a serious one under IT laws and criminal law. The police are likely awaiting forensic reports from the IT Wing to determine the metadata of the files. Those reports usually take 3-4 weeks to finalize.During this waiting period, the political vacuum is dangerous. Shivakumar’s government, already weakened by internal dissent, cannot afford a long legal battle that drags on for months.

They need a quick win or a quick dismissal. Kumaraswamy, conversely, can afford the wait. He is a veteran politician who has survived multiple high-profile scandals in the past. He knows how to outlast his opponents.

The police, caught in between, are the real victims here. They are being forced to choose sides in a fight they didn’t start and can’t easily exit. That’s a brutal position to be in.Historical parallels in Karnataka politicsThis reminds me of the 2019 Lok Sabha riots in Bengaluru, where politicians from all parties used social media clips to inflame tensions. Back then, the police struggled to maintain order because they were seen as taking sides by different groups.

The outcome was a loss of public faith in the uniformed forces for several months. We are seeing a similar erosion of trust now, but slower. The difference is that in 2019, the conflict was communal; today, it is dynastic. The stakes are personal.

Shivakumar sees Kumaraswamy as the biggest threat to his base. Kumaraswamy sees Shivakumar as a usurper who cheated the party. The police are just the stage props.Historically, when a former Chief Minister is targeted by the current one, the state often ends up with a hung assembly or a collapse of the government within 6 months. The 2018-2019 period saw similar tensions before the BJP entered the equation.

This time, the opposition is fragmented. Without a united front, Kumaraswamy’s personal fight may not translate into a political counter-offensive. But it might be enough to keep the government on the back foot. The next few weeks will show if his “guts” narrative can be converted into votes on the ground.

If it can’t, it will be remembered as a desperate, flashy move that failed to change the outcome.Frequently Asked QuestionsDid HD Kumaraswamy get arrested? No, he was not arrested at the time of writing. He voluntarily went to the police station and recorded a video, but the police have not physically handcuffed him. They are reviewing the legal implications before taking any drastic action. What case is HD Kumaraswamy accused of?He is under investigation for alleged involvement in the creation and distribution of compromising “sting” videos of political opponents, specifically Prajwal Revanna. The charges relate to IT laws and criminal intimidation. Why is he demanding the police Commissioner be removed?Kumaraswamy claims the Commissioner is acting under the direct orders of Chief Minister D.K.

Shivakumar to target him politically. He argues that an independent investigation is impossible without changing the leadership of the Bengaluru police force. Will this affect the Karnataka government? It creates significant instability. The Chief Minister’s government is already facing internal dissent. This public confrontation adds to the political pressure and may force the government to rush legal proceedings or negotiate a political settlement.Source: The Hindu
